1. Nature of Activities

The services offered by Soul Fly Lodge involve participation in outdoor activities, including but not limited to fly fishing, wading, boating, skiff operation, swimming, snorkeling, beach exploration, hiking, and travel by small aircraft to and from Great Harbour Cay. These activities take place in remote ocean, flats, and island environments in the Bahamas and involve inherent risks, both known and unknown, including but not limited to:

• Drowning, near-drowning, or other water-related accidents
• Exposure to sun, heat, wind, rain, lightning, and other weather conditions
• Interaction with wildlife including sharks, rays, jellyfish, sea urchins, mosquitoes, and other species
• Sharp coral, broken shells, slippery surfaces, and other underfoot hazards
• Equipment failure, including failure of skiffs, motors, fly rods, lines, hooks, and other gear
• Physical exertion, dehydration, sunstroke, and other physical strain
• Travel-related risks including flight delays, cancellations, and the use of small charter aircraft
• Limited access to medical care due to the remote location of Great Harbour Cay
• Acts of other guests, guides, or third parties

2. Acknowledgment of Risk

By booking a service and/or utilizing information from this Website, you explicitly acknowledge that you understand the inherent risks associated with outdoor activities and travel to remote destinations. You agree that your participation is entirely voluntary and that you assume full responsibility for any injury, loss, or damage to person or property that may occur during or as a result of your trip.

3. No Guarantee of Results

Any fishing reports, photographs, videos, or descriptions of services on this Website are for illustrative purposes only. Soul Fly Lodge makes no guarantee regarding specific outcomes, including but not limited to:

• Catch quantities, species caught, or fish sizes
• Weather, sea, or tide conditions
• Wildlife sightings or behavior
• Specific guides being available on specific dates
• Any other outcome dependent on natural or external conditions

Services are provided "as is," and no refunds will be issued based on the absence of a specific outcome. Fishing is inherently unpredictable, and our guides will always work to put guests in the best possible position for success given the conditions of the day.

4. Health and Fitness Representations

By booking a trip, you represent that you are in adequate physical and mental health to participate in the activities described above, and that you have disclosed any medical conditions, allergies, dietary restrictions, or other limitations to Soul Fly Lodge in advance of your arrival. Soul Fly Lodge reserves the right to decline service to any guest whose participation may, in the sole judgment of the guides or management, pose a risk to themselves or others.

5. Relationship to Physical Waiver

This digital disclaimer serves as a supplement to, and not a replacement for, any physical Liability Waiver or Release of Liability required to be signed by guests prior to participation in fishing or other guided activities at Soul Fly Lodge. By booking a trip, you agree to execute any such physical waiver as a condition of participation.

6. Travel Insurance

We strongly recommend that all guests obtain comprehensive travel and medical insurance, including coverage for trip cancellation, medical emergency, and emergency evacuation. Soul Fly Lodge is not responsible for losses, medical expenses, or evacuation costs that could have been covered by adequate travel insurance.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SOUL FLY LODGE, ITS OWNERS, OFFICERS, EMPLOYEES, GUIDES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INJURY, ILLNESS, DEATH, LOSS, DAMAGE, OR OTHER HARM ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN ACTIVITIES AT OR ARRANGED BY SOUL FLY LODGE, EXCEPT TO THE EXTENT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
